Flexible Cancellation - No Long-Term Lock-In
At NavNext PMO Solutions, we believe in flexibility. You can cancel our services anytime with minimal notice period and no hidden penalties.
1. Cancellation Rights
Clients have the right to cancel any engagement with NavNext PMO Solutions at any time, subject to the notice periods and terms outlined below.
2. Notice Period Requirements
2.1 Hourly/Part-Time Engagements
- Less than 3 months engagement: 7 days written notice required
- 3-6 months engagement: 14 days written notice required
- More than 6 months: 21 days written notice required
2.2 Project-Based Engagements
Cancellation terms as specified in the Statement of Work (SOW). Typically:
- Before project kickoff: 7 days notice, refund of 80% of upfront payment
- After kickoff, before 25% completion: 14 days notice, charges for work completed plus 25% of remaining contract value
- After 25% completion: Charges for work completed plus 50% of remaining contract value
2.3 Monthly Retainer Engagements
- 30 days written notice required
- Pro-rated charges apply for partial months
- Unused retainer hours are forfeited upon cancellation
3. Cancellation Procedure
Step 1: Written Notice
Submit cancellation request via email to info@projectmanagementandsolutions.com with subject line "Service Cancellation Request - [Your Company Name]"
Step 2: Confirmation
You will receive acknowledgment within 24 business hours with:
- Cancellation effective date
- Final invoice details
- Knowledge transfer schedule (if applicable)
- Return of materials/access procedure
Step 3: Transition Period
During notice period:
- Services continue as normal unless mutually agreed otherwise
- Knowledge transfer sessions scheduled
- Documentation handed over
- Final billing reconciliation completed
Step 4: Final Settlement
Final invoice issued covering:
- All hours worked up to cancellation date
- Any applicable early termination charges
- Outstanding expenses (if any)
- Payment due within 7 business days
4. No-Penalty Cancellation Scenarios
Clients may cancel without any penalty or notice period in the following cases:
- Performance Issues: If assigned resource consistently fails to meet agreed performance standards after written warnings
- Ethical Violations: Any breach of confidentiality, conflict of interest, or unprofessional conduct by NavNext staff
- Force Majeure: Events beyond your control (company closure, funding loss, regulatory changes, etc.)
- Mutual Agreement: Both parties agree to immediate termination
5. Early Cancellation Charges
5.1 Standard Engagements
If cancellation without proper notice period:
- Charges apply for hours worked during the notice period you didn't provide
- Example: 14 days notice required, you gave 7 days - you're charged for additional 7 days at contracted rate
5.2 Fixed-Price Projects
See section 2.2 above. Charges based on project completion percentage and work invested.
5.3 Long-Term Contracts (6+ months)
If contract includes volume discounts or special rates for long-term commitment:
- Early cancellation may require adjustment of rates to standard pricing
- Retroactive invoicing of difference for services already rendered
- Details specified in individual contracts
6. Client-Initiated vs. NavNext-Initiated Cancellation
6.1 Client-Initiated
Terms as outlined above apply.
6.2 NavNext-Initiated
NavNext may cancel engagement with 30 days notice if:
- Client fails to make timely payments (invoices overdue 30+ days)
- Client breaches confidentiality or intellectual property terms
- Client requests activities that are illegal or unethical
- Working relationship becomes untenable due to client conduct
In such cases, client receives credit for any advance payments for services not rendered.
7. Resource Replacement vs. Cancellation
Not satisfied with assigned resource? Try resource replacement before cancellation:
- Free replacement of PM/BA/Product Manager once during engagement
- 2-week transition period with new resource
- No charges during replacement transition
- Only if issues persist should you consider cancellation
8. Partial Cancellation
For engagements involving multiple resources, clients may cancel individual resources while continuing with others. Standard notice periods apply to each resource cancellation.
9. Reactivation Policy
Cancelled services can be reactivated within 90 days at previously agreed rates. After 90 days, current market rates apply. No reactivation fees.
10. Data and Deliverables
Upon cancellation:
- All work products completed and paid for will be delivered to client
- Work-in-progress delivered in current state (may be incomplete)
- Client data and confidential information deleted from NavNext systems within 30 days
- Client responsible for downloading/backing up any shared documents before cancellation effective date
11. Non-Refundable Items
The following are non-refundable upon cancellation:
- Setup/onboarding fees (if applicable)
- Third-party tool licenses purchased specifically for your project
- Travel expenses already incurred
- Training or certification costs for specialized skills requested by client
12. Cancellation Disputes
If there's a disagreement about cancellation terms or final charges:
- Contact our management team for review within 10 days of final invoice
- We'll conduct internal review and respond within 7 business days
- If still unresolved, matter referred to mediation before arbitration
13. Cooling-Off Period
New Clients: First-time engagements include a 14-day "try before you commit" period. If you're not satisfied within first 14 days, cancel with full refund of any advance payments (minus hours already worked at standard rates).
14. Written Communication Required
All cancellation requests must be in writing via email. Verbal cancellations are not accepted. Cancellation effective date is the date written notice is received, not the date of verbal communication.
